Terms of Service — Boutique Ultrasound

These Terms of Service ("Terms") govern your access to and use of Boutique Ultrasound ("we", "us", or "our"), including the AI-keepsake generation service available at boutiqueultrasound.com and app.boutiqueultrasound.com.

By creating an account or making a purchase, you agree to these Terms and to our Privacy Policy and Refund Policy.

1. What we are — and what we are not

Boutique Ultrasound is a digital keepsake service. You upload a photograph of an ultrasound scan that has already been performed for you by a healthcare provider; our AI renders artistic interpretations of that scan in several styles (realistic newborn portrait, watercolor, dreamy, starry night, classical oil) for your personal enjoyment.

We are not a medical service.We do not perform ultrasounds. We do not diagnose, treat, prevent, or screen for any condition. We do not predict your baby's actual appearance, gender, health status, or development. The output of our AI is an artistic interpretation only — it is not a medical record, not a diagnosis, and not a substitute for prenatal care from a qualified healthcare provider. 2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account or purchase credits. By using the service, you represent that you meet this requirement.

3. Your account

You may create an account by signing in with Google or by receiving a magic-link email from us. You are responsible for keeping your sign-in method secure. We may suspend or terminate accounts that violate these Terms, attempt to abuse our refund or credit systems, or attempt to upload content that is illegal, another person's scan without their permission, or content that violates the rights of any third party.

4. Credits and pricing

Credits are purchased in fixed packs ($9 / 1 credit, $14.99 / 3 credits, $45.99 / 15 credits, $89.99 / 40 credits, USD). One credit produces one keepsake delivery (a realistic newborn portrait + 4 painterly styles + a branded keepsake frame).
Credits are valid for 18 months from the date of purchase. Unused credits expire at that date. We do not offer cash refunds for expired credits.
Prices may change for new purchases at any time. Credits you already own are not affected by price changes.
Payments are processed by Stripe, Inc. We do not store your full payment-card information.

5. Refunds

See our full Refund Policy. In short: if a generation fails for technical reasons on our side, the credit is automatically returned to your account at no charge. If you are unsatisfied with the artistic output of a successful generation, please email us — we will work in good faith to resolve it, which may include a re-generation or a refund of the credit at our discretion.

6. Your scan, your output, your archive

You retain all rights to the ultrasound scan you upload. By uploading, you grant Boutique Ultrasound a limited, revocable, non-exclusive license to process the scan solely for the purpose of generating your keepsake outputs and delivering them to you.

Generated outputs are yours to keep, share with family, and print for personal use. You may not resell our generated outputs or use them in commercial advertising without written permission.

We do not train AI models on your scan.Your uploaded scan is not used to train any model — ours, our providers', or any third party's.

Your archive (uploaded scans + generated keepsakes) lives in your account. You may delete a single keepsake, an entire pregnancy, or your whole account at any time from your studio dashboard. You may also enable auto-deletion (30 days, 1 year, custom).

7. Acceptable use

You agree not to:

Upload content you do not have the right to upload (someone else's scan without their consent, copyrighted material that is not yours, etc.).
Use the service to generate content that depicts minors in a non-keepsake context, or any content that is harmful, harassing, sexually explicit, or otherwise illegal.
Attempt to reverse-engineer, scrape, replicate, or redistribute the service or its outputs at scale.
Use the service to make medical claims, diagnose any condition, or pass off generated content as a real medical ultrasound.

8. AI provider disclaimers

Our AI generation runs on third-party large-language and image models (currently provided by Google through the Gemini API and by Replicate through Real-ESRGAN). The output reflects what those models produce based on your input and our prompts. We do not guarantee accuracy, fidelity to the source scan, or specific aesthetic outcomes.

9. Limitation of liability

To the maximum extent permitted by law, Boutique Ultrasound, its operators, and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim related to the service is limited to the greater of (a) the amount you paid for the credit(s) at issue, or (b) USD $50.

Some jurisdictions do not allow these limitations; in those jurisdictions, the limitations apply only to the extent permitted by law.

10. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will email registered users and update the effective date above. Your continued use of the service after the effective date of the updated Terms constitutes acceptance of the changes.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and Boutique Ultrasound agree to the exclusive jurisdiction of the courts of Ontario for any dispute that cannot be resolved by good- faith negotiation.
